Opinion: Pensions, Politics and the New Jersey Education Association

"Ensuring the protection and improvement of our members’ pensions and benefits has been our top priority at NJEA since 1896," stated Joyce Powell, NJEA President in June 2006.

Over the past twenty years, the New Jersey Education Association has upheld Powell’s words, as exemplified by its influence on state senate president and former gubernatorial candidate, Steve Sweeney.

New Jersey is currently facing a severe pension crisis, with the state’s unfunded pension liabilities estimated at $95 billion under new accounting standards. Additionally, retiree health care obligations contribute an additional $65 billion, resulting in a total of $160 billion in liabilities. This figure does not even include an additional $40 billion for local government pensions. To put this in perspective, the entire state budget amounts to $35 billion.

Given this situation, it is evident that the state lacks the necessary funds to fulfill its pension obligations.

However, last year, NJEA attempted to pass a constitutional amendment that would solidify this bankrupt system within the state constitution, regardless of the devastating consequences on the state’s budget. Senator Sweeney refused to support this amendment, leading to a promise of revenge from NJEA and subsequent actions to fulfill it.

So, how did we reach this extreme situation?

The underfunding of state pensions is a direct result of NJEA’s significant political power. As former president Michael Johnson stated in 1998: "Our exceptional pension system is the outcome of hard-fought legislation and politics." Every aspect of public pensions is influenced by political decisions, and NJEA holds a dominant position of political influence within the state.

The union not only ranks as the top political spender in New Jersey but also boasts thousands of volunteers who actively engage in campaigns across all districts. Additionally, the UniServ program, a statewide group of political professionals, aids local unions in mobilizing voters. NJEA’s Communications and Government Relations divisions effectively shape and communicate its political agenda, further amplifying its influence.

Moreover, NJEA’s reported political spending does not factor in its annual Pride in Public Education campaign, which aims to promote a positive image of schools within local communities. However, the campaign also organizes efforts to secure "yes" votes for school budget elections, even if it may harm the district.

Between 1995 and 2015, NJEA has spent a staggering $756 million on building political influence, clearly reflecting its real-life impact.

With such immense financial power, NJEA has often achieved its desired outcomes regarding pension policies. This was evident in the early 1990s when NJEA supported 46 Republicans and 3 Democrats in state elections after Democrats made changes to pension distribution by shifting responsibilities to local school districts. The union’s support was instrumental in flipping the legislature to the GOP. The resulting bipartisan majorities in the legislature subsequently passed legislation that expanded pension benefits.

In 1997, NJEA successfully obtained the "non-forfeitable right" to pensions for its members, ensuring that 89% of today’s teachers are protected from any reductions. This has complicated future reform efforts significantly, such as Governor Chris Christie’s reforms in 2010 and 2011, which primarily affected new teachers.

In 2001, the legislature approved a 9% pension increase, despite a significant decrease in pension fund assets due to the dot-com bust. Only one legislator opposed the proposal. NJEA hailed this increase, which essentially raided the pension fund, as one of its most significant accomplishments.

Crucially, NJEA managed to keep teacher salaries negotiated at the local level separate from pension payouts negotiated with the state. This separation ensured that rising pension costs did not place additional strain on local education budgets or necessitate higher property taxes.

At the state level, NJEA actively advocated for improved pensions and benefits. Governor Christie expressed that the average teacher contributes $195,000 over a 30-year career but receives $2.6 million in benefits. The state’s Benefits Review Task Force reached a similar conclusion in 2005.

However, lawmakers, in an effort to please NJEA and prevent tax increases, further enhanced pensions without adequately funding them. Although the union had the political influence to press the legislature for sufficient funding, it instead worsened the problem by exerting its force only when increased benefits were threatened. Throughout this period of underfunding pensions, candidates endorsed by NJEA and incumbents supporting the current system continued to be elected at high rates.

When viewed within the historical context of NJEA’s strong influence over the legislature, we can understand its 2016 attempt to burden taxpayers with the $95 billion pension shortfall by constitutionally entrenching the bankrupt system. After Senator Sweeney declined to support NJEA’s amendment, the union pledged to support his potential opponents in the 2017 Democratic gubernatorial primary. Surprisingly, Sweeney withdrew from the race in October, causing a stir in the state’s political landscape.

Sen. Elizabeth Warren responded to the decision by emphasizing that corporate interests have been favoring the system against workers for a long time. She shared a video featuring teachers union leaders arguing against the ruling and stating that they will continue to fight for their rights. Former education secretary John King also shared an article written by the president of the American Federation of Teachers, Randi Weingarten, which highlighted the importance of teachers voicing their opinions.

Weingarten herself tweeted that the union will remain strong despite the ruling, emphasizing that workers stick with the union because it is still the best vehicle for working people to get ahead. Erika Sanzi, a parent advocate and visiting fellow at a conservative think tank, responded to Weingarten, pointing out that polls indicate a majority of Americans do not believe union members should be obligated to pay dues.

Hidden Costs of Senate Health Care Bill: Uninsured Kids Do Worse in School, More Likely to Drop Out

Senate Republicans unveiled their proposal to repeal Obamacare this week after weeks of secretive negotiations. While the plan would bring significant changes to insurance markets, the focus on cost analyses and political speculation has overshadowed a crucial aspect of the story: the impact of unraveling Obamacare on K-12 students and the potential threat to their academic achievements.

When House Republicans narrowly passed their own version of the repeal in May, examined the potential costs that states would bear if federal Medicaid funding, which was greatly expanded under Obamacare, was rolled back. Alarming findings from the progressive Center on Budget and Policy Priorities revealed that school districts could face competition with doctors and hospitals for the limited remaining funds. This could result in austerity budgets that do not have sufficient resources to support services like speech and occupational therapy, mental health counseling, and other essential programs that are currently funded through Medicaid.

The upcoming legislation, which is expected to be voted on next week, maintains the House bill’s drastic cuts to Medicaid, which currently provides approximately $4 billion each year to school districts. These funds serve as a crucial supplement to the chronically underfunded revenue streams from the Individuals with Disabilities Education Act. However, Medicaid is not the only component of the GOP’s repeal efforts that will impact schools.

Since the enactment of Obamacare in 2010, the number of uninsured American children has significantly declined. Some children gained coverage through enhanced Medicaid programs, while others obtained insurance through the newly established state exchanges. If congressional Republicans eliminate the funding for both of these initiatives, the Urban Institute predicts that around 4.4 million children could lose their insurance coverage by 2019.

Apart from the public health consequences of this development, the academic ramifications could be substantial. Numerous studies indicate that access to early medical care through insurance programs like Medicaid leads to improved academic outcomes and future life success. For example, a 2014 paper from the National Bureau of Economic Research found that expanding Medicaid eligibility for children could reduce the risk of high school dropout by 6 percent and increase the likelihood of college completion by 3 percent.

The authors of the study concluded, "Our estimates suggest that the long-term benefits of providing health insurance access to children are greater than the short-term improvements in health status. Additionally, these expansions can contribute to a reduction in inequality and promote higher economic growth by creating a more skilled workforce."

While these findings may not be surprising, it is crucial to recognize that uninsured children do not perform as well in school compared to their peers who have access to regular medical care. The past year has witnessed a rise in the presence of "First Amendment auditors" visiting public libraries all across the United States, including Michigan. These auditors aim to test the permissible limits of filming inside library premises.

The concept of First Amendment "audits" involves individuals purposefully visiting public spaces such as police stations, city halls, and libraries to uncover potential violations of their First Amendment rights. While these audits have been occurring for several years, the American Library Association’s Office for Intellectual Freedom reports that they have become more forceful since the beginning of 2021.

The First Amendment guarantees the protection of various rights, including freedom of speech, religion, press, assembly, and the right to petition the government.

Deborah Mikula, executive director of the Michigan Library Association (MLA), explains that the auditors have diverse motives. Some seek fame and recognition on platforms like YouTube, while others intentionally provoke confrontations. These auditors create videos to claim infringement of their First Amendment rights, expecting reactions from library staff or the police.

This issue adds to the ongoing debates surrounding public libraries, which have attracted national attention due to discussions on banning certain books.

Lance Werner, the executive director of the Kent District Library system in Grand Rapids, reveals that auditors have visited each branch within the system. However, no instances of harassment or hostility have been reported.

"We treat everyone with empathy, kindness, love, and respect, regardless of whether they enter the library to film employees or ask probing questions," Werner affirms. "It doesn’t concern us. We are transparent and acknowledge everyone’s right to be present in the library. The only situation that would matter to us is if they interfere with other patrons."

While the public has the right to film inside public buildings, the Library Privacy Act in Michigan safeguards the privacy rights of patrons concerning the materials they read or borrow from the library.

Mikula highlights the importance of considering the privacy of other library users. Protecting their privacy is a crucial aspect of the conversation within libraries, as it involves not only librarians but also numerous other individuals present in the buildings.

To address this issue, the Michigan Library Association has been providing training to librarians on de-escalation techniques.

"Our aim is to ensure that our librarians feel confident in handling First Amendment audits, and that’s all we can do," Mikula asserts.

The scrutiny on libraries has intensified in recent months, particularly due to nationwide discussions on book bans. Republican groups, such as the national organization No Left Turn in Education, have spearheaded these efforts primarily targeting school libraries and seeking to ban books discussing topics of race, gender, and sexuality.

Werner notes that since the beginning of the previous summer, the number of challenges against books received by the Kent District Library has noticeably increased, with informal challenges arising on a weekly basis.

Werner clarifies that very few books would actually be banned from any of the KDL public libraries. For a book to be removed from the library’s collection, it would need to fall under the category of pornography or child pornography, as these are not protected by the Constitution.

According to the preliminary report on America’s Libraries by the American Library Association, there were over 330 unique book challenges reported nationwide between September 1 and November 30, 2021. This number represents more than double the reports received in 2020 (156 challenges) and is expected to surpass the figures from 2019 (377 challenges).

"We strive to do right by people and prioritize upholding the Constitution," Werner emphasizes. "We treat everyone with kindness, and society will continue to act as it does. I just wish everyone understood that we have no hidden agenda and do not endorse any specific agenda. We remain politically neutral."

Building the 3.0 High School: How Summit Basecamp Schools Pairs Teaching With Technology

The documentary Most Likely to Succeed, released in 2015, focuses on the educational revolution of High Tech High, a charter school in San Diego that was established in 2000 and has since expanded to 13 schools, including those for elementary and middle school students.

An early indicator of High Tech High’s potential was the school receiving a grant from the NewSchools Venture Fund.

Larry Rosenstock, the founder, has created a truly unique vision for education. The classrooms do not adhere to traditional subjects, teachers have annual contracts, and there are no bells to signal the beginning and end of periods. The entire learning experience is project-based, with the aim of developing important skills such as collaboration, time management, resourcefulness, and resilience. In essence, High Tech schools are a pioneering example of student-directed learning, predating the adoption of similar approaches by other schools. The documentary is highly recommended, and visiting one of Rosenstock’s schools is worthwhile.

Although there are now numerous school models that have caught up to and even surpassed High Tech High in terms of promising visions for education, some of these models may be easier to replicate. Many of these schools receive support from Next Generation Learning Challenges, which is funded by the Gates Foundation and focuses on next-generation philanthropy.

However, this moment represents the culmination of various factors. Firstly, Blackstone Valley Prep is already recognized for its success in attracting a diverse student body, including both middle-class and underprivileged students. Secondly, the school received a significant grant from Next Generation Learning Challenges to explore innovative approaches to high school education. Lastly, one of the most forward-thinking charter groups in the country, Summit Public Schools in California, contributed their Summit Basecamp software to the program. The software, developed with the assistance of top code writers from Facebook, offers personalized learning opportunities. Blackstone was chosen as one of the early adopters of this learning program, and although it is relatively new, it shows great promise.

The story comes together with Ray Varone, the 15-year-old student, proudly demonstrating the Basecamp program. As anyone from a certain generation who has witnessed a teenager showcasing software can attest, the initial reaction is usually, "Wait, slow down! Show me that again!"

Blackstone’s charter high school represents the cutting edge of the search for the next version of high school, referred to as Version 3.0. This school will lead us into the future of education, but where is it, and what does it look like?

Locating such a school should not be a difficult task. For the past few years, some of the brightest minds in technology and the most influential foundations in the United States have collaborated with the White House to address one of the most challenging issues in education: high school is boring.

Yes, this is not news to anyone with first-hand experience. However, the situation has only worsened over time.

While efforts to improve elementary and middle schools have shown results in test scores, the same cannot be said for high schools. High school is where many students drop out, particularly in ninth grade when they first encounter it. Obtaining a high school diploma often proves to be of little value when students attempt college placement tests. The situation has become so dire that movies are being made about it.

While it is true that there are private and affluent suburban schools where the quest to gain admission to prestigious colleges creates immense pressure, these cases are exceptions that attract significant media attention.

For the majority of high school students, the problem lies on the other end of the intensity spectrum. Low-income and minority students, who now make up approximately half of the student population in the nation, either do not attend college, quickly become ineligible for credit-bearing courses, or drop out before completion.

So, what do these brilliant innovators in high-tech school reform have in mind? There are a few places across the country where one can catch a glimpse of their ideas, and Blackstone is one of them.

In simpler terms, charter schools that focused heavily on their unique culture and significantly improved K-12 education discovered that once their students moved beyond the boundaries of that intense classroom culture, they struggled to thrive independently. To put it briefly, they lacked resilience and determination. This research prompted many impactful changes in charter schools, with KIPP leading the way. The charters concluded that a complete shift to personalized learning was necessary in order to develop the necessary independent learning skills that would guide students through their college journey, which can often be a solitary experience. The term used to describe this approach was self-directed learning.

The software called Basecamp, which Varone is currently using, completely changes the traditional approach to learning. The students have control over when and where they learn, whether it be at school or at home. Classroom time is primarily used for projects, group work, and receiving guidance from teachers on how to manage their "Personalized Learning Plan" (PLP). Unsurprisingly, Basecamp originated in Silicon Valley. Summit charter schools, which were already at the forefront of personalized learning, caught the attention of Facebook CEO Mark Zuckerberg during his visit in 2013. Zuckerberg provided a team of code writers to Summit, resulting in the creation of Basecamp, a PLP designed for students in grades 6 through 12 across all subjects.

So, what does this new learning style entail? Basecamp offers approximately 200 "deeper learning" projects and 700 playlists consisting of videos, articles, and any resource that enhances knowledge on various subjects. Basecamp is also adaptable, allowing schools to add or remove content they deem important. Blackstone made considerable changes to the math curriculum using this flexibility. For this school year, 19 schools, including Blackstone, were chosen as early adopters of this approach.

As Varone demonstrates his progress in different subjects, everything seems to blend together. His projects are color-coded to indicate whether they are still pending or completed. The core feature of the software, agreed upon by everyone, is the vertical "pacer line" that runs through all the projects. This line shows students where they stand on each assignment and whether they are ahead or behind schedule, providing a benchmark even as students are allowed to work at their own pace.

Varone proudly displays his progress on each subject, claiming that this independent approach will prepare him for college. "We’re getting used to doing this on our own, so we’ll be prepared for college. In college, teachers won’t be there asking us questions all the time, so we have to learn independently."

I agree that his response seems rehearsed, but there was nothing rehearsed about his demonstration on the Basecamp software. This was self-directed learning, which is the ultimate goal of any high school reinvention in the next generation.

When Jeremy Chiappetta, the Executive Director of Blackstone, and other educators set out to design a high school program for Blackstone students, they drew inspiration from the lessons learned at KIPP. They wanted to reshape the curriculum around developing skills that would help students succeed in college. They realized that their middle school model, while providing a strong foundation in academic skills, discipline, focus, and habits, would not be sufficient for the high school level.

Blackstone’s quest for a new model led to a $450,000 grant from Next Generation Learning Challenges and their decision to participate as an early adopter of Basecamp. This status ensured support from Summit, including training sessions and guidance from a former teacher.

As a result, Varone reviewed his PLP and felt confident that he was on top of his work and ready for college. And he didn’t seem bored at all.

According to Diane Tavenner, the founder of Summit and the chief engineer behind Basecamp, this is how the system is supposed to work. It’s about giving students ownership and responsibility while the role of the adults is to facilitate learning and act as mentors and guides.

Blackstone is one of 24 partner schools across the country involved in piloting the Basecamp platform. However, it’s important to note that Basecamp is not the exclusive model that all charter schools will adopt. According to Tavenner, there is no one-size-fits-all model. Education is constantly evolving and adapting.

This perspective aligns with the innovative mindset of Silicon Valley and the charter school movement.
